Real life Paternity Fraud: "Its not your baby fool!"

CNN) -- Frank Hatley spent the past year in jail for being a deadbeat dad. But there's one problem -- Hatley doesn't have any children. And the "deadbeat" label doesn't fit the 50-year-old either, his supporters say.

After a hearing, Hatley was released from the Cook County Jail in south Georgia Wednesday afternoon, with the help of the Southern Center for Human Rights.

Superior Court Judge Dane Perkins ruled that Hatley was indigent and should not be jailed for not being able to make child support payments. Perkins postponed a decision on whether Hatley should have to make any more back payments on child-support for a child who is not his.

In June of last year, a judge ordered Hatley to jail for failing to reimburse the state for public assistance that was paid to support his "son," who, as the court was aware, is not actually his son.

Hatley's attorney Sarah Geraghty, who filed a motion for his release, called it a case of "blatant unfairness."

Hatley is a hard-working man who demonstrated his desire to pay what the court said he owed, even making payments from his unemployment checks, Geraghty told CNN.

On top of that, "the state has no legitimate reason to pursue Mr. Hatley for child support -- he doesn't have any children," she said.

The story dates back to 1986, when Hatley had a relationship with Essie Lee Morrison. She became pregnant and gave birth to a son.

Morrison told Hatley that the child was his, but the couple ended their relationship shortly after the boy's birth, according to court documents. The couple never married and never lived together, the documents state.

When the boy turned 2, Morrison applied for public support for her son. Under Georgia law, the state can go after the non-custodial parent to recoup the assistance.

For 13 years, Hatley made payments to the state until learning, in 2000, that the boy might not be his biological son. A DNA test that year confirmed that there was no chance he was the father, according to court documents.

Hatley returned to court and was relieved of any future child support reimbursement but was ordered to pay more than $16,000 that he had owed the state before the ruling.

Latesha Bradley, an attorney who represented Hatley in that hearing, told CNN the argument for keeping Hatley liable for the back payments was that he had signed a consent agreement with the office of child support services. The court agreed that Hatley had to comply with the consent agreement for the period that he believed the boy was his son.

Court documents show that Hatley for the most part continued to make payments. He was jailed for six months in 2006 for falling behind on payments during a period of unemployment, but afterward he resumed making payments and continued to do so even after he lost another job in 2008 and became homeless, court records state.

Last year, he again became unable to maintain the payments and was once again jailed.

The circumstances of Hatley's arrest didn't feel right to many, including Cook County Sheriff Johnny Daughtrey.

"I knew the gentleman's plight and didn't know how to help him," Daughtrey told CNN.

About two months ago, when attorneys from the Southern Center for Human Rights visited his jail, Daughtrey alerted them to Hatley's case.

Sometime you think you are doin the right thing and it is not. People lie to get what they want and make other suffer for the mistake this is wrong and then you get caught up in the system and pay for it the rest of your life.

THIS HAS TO BE A JOKE. This man has paid child support for all these years to a woman who most likey knew that this was not his child in the first place. Then the court system continued to screw this fellow. there is no telling what this man could have became if this crap wasn't hanging over his head. He should be compensated for all his wasted time by the courts and this lying ass woman. I BET THIS KIND OF STUFF HAPPENS A LOT.

This is terrible what our domestic court systems are doing to this man and everyone else in this situation.

The has nothing to do with justice and everything to do with equity. This going on in almost all states and every nationality. This is about generating equity for the state from the federal governments funding in an attempt to reduce the welfare cost, by perpetrating fraud. I am a married man that has to pay for paternity fraud and perjury committed in court. I tried to challenge paternity and ask to adopt the child, so there would not be any issues when the child got older and began questioning paternity and the mother manipulating the child for the sake of money and control. I was duped into marrying the woman that convinced me that the child she was carrying was mine. The judge denied my request for a paternity test and adoption as well as a request for joint shared custody, because I wanted to do what I could for the child. Everything that I suspected has come true. The mother manipulated the child from wanting to be with me. The child knows I am not his biological father and blames me for this mess. I know this will one day blow up in her face, but in the mean time I have paid over $150,000 in child support and still have 5 more years to go. It has gotten to the point where I don't even care about the money anymore, I just want justice and this outrageous act stopped on everyone in this country.

AS A WOMAN I HATE TO SAY THIS BUT - WHY DON'T THESE LYING WOMEN GO TO JAIL. START BY PUTTING ONE LYING B.... IN JAIL AND YOU WILL SEE HOW FAST THEY REMEMBER THE ACTUAL BABY DADDY. POOR MAN -TRAUMATIZED ALL HIS LIFE; PUT IN JAIL. SHE SHOULD BE ASHAMED. WHERE ARE THE REPERCUSSIONS FOR HER LIE. THINK TWICE ,WOMEN, BEFORE YOU LET YOUR GREED RUIN A MAN'S LIFE. PEOPLE SHOULD HAVE THE CHOICE TO BECOME OR NOT TO BECOME PARENTS. DON'T WE HAVE ENOUGH CHILDREN WHO DON'T KNOW THEIR FATHER'S ?

not only should he not be in jail he should be refunded all the money paid for this child another case of how our justice system is no good .and free paternity test for all men

Oh my god! this seems highly unfair. This woman lied about the son being his, when it was proven true that the child wasn't this man's, the law raped him again. I don't see why she can't pay for lies. This man should have the money returned in full. I pray he gets some restitution.

It should be mandatory that DNA is taken before child support is ordered on a man. It is a shame that a woman have a baby and can name any man as the father to get money. I know we want be entrepreneurs, but this business is not right.

If women have to repay the men, they will think twice about playing eeny, meeny, miny, moe.

I think it's ridiculous to put this man behind bars for not paying child support for a child that's not his. Once it was proven that he was not the father, the support order should have been canceled; deleted from the books. And to try and make him pay back support is stupid. The mother should be reimbursing the state for any money she received or put in jail. Any woman knowing a man is not the father of a child but tries to go after the man anyway is just trifling.

Shame, shame, shame, shame, shame. Promiscuous women are being rewarded. If you luck up on a baller or have children with different daddies, you can retire. The laws are clearly outdated and fathers are getting the short end of the stick. That women should have to pay all that back money to him. He should have been off the hook for the arreas when it was proven he was not the father. By the way, I am a female with a son going through this.

I feel for this guy. Also, shady women doing this mess are the ones that need to be locked up and have to pay the money back. It's funny how the system work. Clearly know this man is not the father but is force to pay money back for a situationn an ex-girlfriend created.
